This Privacy Policy describes how and when I collect, use, and share information when you purchase an item from me, contact me, or use my services through Etsy.com or its related sites and services.
This Privacy Policy does not apply to the practices of third parties that I do not own or control, including Etsy or any third party services you access through Etsy. You can reference the Etsy Privacy Policy to learn more about its privacy practices.
1. The information I collect, why I need it and how I use it
I will only collect your name, postal address and email address in order to ship the goods you have purchased to the correct person and location. I may use your email address to contact you if there is an emergency regarding your order, and you are unable to respond urgently via Etsy Convo. I may also contact you via email if I need to send you multiple images, exceeding the attachment limit of Etsy Convo, which would be in response to your request.
I do not receive your telephone number unless you have provided it, for example, via Etsy Convo to arrange a collection in person. If I do need to collect your telephone number, I will not share it with any third party.
Your invoice will include the information, which you authorised Etsy to provide to me: your full name and Etsy profile name, your postal address, your order date and ‘scheduled to ship by’ date, details of the item(s) you have ordered, and the method in which you paid for it/ them. * Please note, Etsy do not disclose any of your bank details to me.
I will print your invoice once, in order to enclose a copy with your items, and I will save it electronically (on a device which is password protected). This is in case I need to refer back to these details in future - e.g. if there are any problems with your order, any legal or tax implications, or when reviewing my sales statistics.
2. Information sharing and disclosure
Information about my customers is important to my business. I therefore share your personal information for very limited reasons and in limited circumstances, as follows:
Etsy: I share information with Etsy as necessary to provide you with my services and comply with my obligations under both the Etsy Seller Policy and Etsy Terms of Use.
Service providers: I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies. These companies include Royal Mail (https://www.royalmail.com/) and My Hermes (https://www.myhermes.co.uk/). I will share your personal information with these third parties, but only to the extent necessary to perform these services.
Business transfers: If I sell or merge my business, I may disclose your information as part of that transaction, only to the extent permitted by law.
Compliance with laws: I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to. Such reasons would be to respond to legal process or to government requests; to enforce my agreements, terms and policies; to prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or to protect the rights, property, and safety of my customers, or others.
I will not share the details of your invoice with any third party, unless HMRC (https://www.gov.uk/government/organisations/hm-revenue-customs) and/ or my accountant/ Yorkshire Accountants Ripon (https://www.yaripon.com/) requests to view them as proof of my income for tax purposes. It is unlikely that any such actions would occur and where necessary, they would be required infrequently.

3. Data retention:
My aim is to retain your personal information only for as long as necessary. This will be for 7 years from the 5th April, after which your order has been made. This is for tax purposes/ record keeping and I may also be required to retain this information to comply with any legal and regulatory obligations, to resolve disputes, and to enforce my agreements.
4. The legal foundations I rely on to collect, use, and share personal information
I collect, use, and share your information, for the following legal reasons:
- To provide the services you requested and fulfil your order
- To settle disputes, or to provide customer support
- When you have expressed your affirmative consent in writing, which you may revoke at any time, such as by signing up for my mailing list
- To comply, (if necessary), with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law.
- Where applicable, for the purpose of my legitimate interests, such as providing my services, requesting feedback and improving my services, if those legitimate interests are not overridden by your rights or interests.
- I use your information as necessary to comply with my obligations under the Etsy Seller Policy and Terms of Use.
5. Transfers of personal information outside the EU
I do not do so currently, but in future may need to store and process your information through third-party hosting services in the US and other jurisdictions, (e.g. Dropbox or Google Cloud). As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If I am deemed to transfer information about you outside of the EU, I will rely on hosting services who comply to Privacy Shield as the legal basis for the transfer. (Drop Box and Google Cloud are Privacy Shield certified).
6. Your rights
If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:
Access: You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.
Change, restrict, or delete: You may also have rights to change, restrict my use of, or delete your personal information. There may be exceptional circumstances, (for instance, where I am required to store data for legal reasons), but I will generally delete your personal information upon request.
Object: You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have legitimate grounds to continue using that information (e.g. for legal reasons).
Complain: If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
